For the past three years the federally recognized tribe, Koi Nation, has been navigating the legal carousels it takes to get sacred land recognized by the federal government. While they already have land that is “in trust”, the Koi Nation wants to expand their land to include some acreage in Sonoma County.

Koi Nation is one of the few recognized tribes in the state that does not own one of the 18+ California casinos. The tribe argues that where their land sits there is no reason to have a casino as it would not attract enough business. To overcome the landscape obstacle, the Koi Nation has bought property in Sonoma County and has submitted plans to build a $700 million-dollar casino resort. The casino is set to feature 2,500 slot machines, table games, six restaurants, and a 400 room hotel.

Darin Beltran, chairman of the Koi Nation Tribal Council, stated “The Koi Nation has been afforded for the first time in over a century a real opportunity to build a sovereign land base that will provide economic development, self-governance, and a bright future for current and future generations of our tribal citizens.” Beltran also stated, “The government’s approval fills our hearts with promise and hope.”

Opponents to the casino project are expected to put up a legal fight and with a new administration set fourth on reversing everything Biden, many expect this recent ruling could get reversed.

There are currently more that 75 local California casinos all owned and operated by federally recognized tribes. Each casino is located on a reservation, and only a few are close to big metropolitan areas. The Indian Gaming Regulatory Act (IGRA) requires tribes to establish a historical connection to lands acquired for gaming before the federal government will place those lands into trust. The Nation claims their people have occupied the Sonoma County area for thousands of years.

A county health spokesman told news sources that out of 11 confirmed T.B. cases, 10 of them are directly linked to the California Grand Casino via players and staff. However, the source of the transmission has yet to be discovered. 

Dr. Meera Sreenivasan said that the C.C.H. is making this recommendation because there is new evidence that T.B. may have spread among people who spent time at the casino from 2018-2023. Dr. Sreenivasan said that T.B. can live inside the human body for years before showing signs of its presence. 

The California Grand Casino released a statement saying that they are working with health officials and that none of the confirmed cases are currently contagious or involve any of their current staff members.

The proposal, titled California Legalize Sports Betting On American Indian Lands Initiative, aims to regulate the operation of retail sportsbooks at tribal casinos. In addition to exclusive sportsbook privileges, the tribes would gain access to roulette and dice games.

A Vocal Community Response

Partnering with a group called Taxpayers Against Special Interest Monopolies, five prominent community leaders banded together and published an opposition statement. 

Among them were Fresno Councilmembers Luis Chavez and Mike Karbassi, as well as Tulare County Supervisors Amy Shulikan and Peter Vander Poel. 

All of the leaders made compelling arguments. But Vong Mouanoutoua, a Councilmember for the City of Clovis, closed the letter with a robust statement. He says,

“This initiative does nothing more than encourage abusive litigation that hurts locally owned and operated businesses, widens California’s opportunity gap, and threatens much-needed tax revenues. California’s Central Valley is already reeling from skyrocketing gas prices, inflation, housing costs and poverty and the eligible tribal gaming initiative will only make it worse.”

The religious sector of North Carolina is baffled a bill allowing betting and pari-mutuel wagering has sailed through Senate committees. However, it is not that surprising when considering that the Cherokee tribe in NC is the state’s top political contributor. Senator Jim Davis, a Republican, responded to the religious group’s concerns about growing gambling addiction with the fact that these tribal operations will bring in jobs to the poorer areas of the state.

Through contributions to policymakers and governors, tribes reserve political power when it comes to potential legislation directly affecting their industry. According to data released by the National Institute on Money in Politics, tribal governments in US states have contributed more than $114 million to state-level candidates and political committees over the last decade.

Some states were blindsided, like California and Florida, by previous decisions to allow amendments which now require expanded gaming to receive majority support via voter referendum. This makes being competitive with neighboring states more difficult, potentially driving away even domestic gambling dollars away.

The status of expanded gambling in the United States, particularly in certain states, is entirely dependent on the attitude of tribes toward each form of gaming introduced. Some tribes are for it while others are completely against it.
