										<content:encoded><![CDATA[<p>On Friday, Florida governor Ron DeSantis and the Seminole Tribe of Florida signed a new gambling compact that will allow domestic sports betting and new casino games to launch in the Sunshine State.</p>
<p>The compact is a major step forward for both parties, representing a final, agreeable remedy to an ongoing dispute that reared its ugly head when FL was found – in 2016 – to have violated its 2010 compact with the Seminole.</p>
<p>Since 2018, as a result of a ruling in federal court to that effect – the Seminole have withheld its annual slots revenue share with the state.</p>
<p>This represented a minimum $350 million annual addition to state coffers.</p>
<p>Today, with the new compact and the new casino games it allows – along with sports betting rights for the Seminole – that share would be upwards of $500 million.</p>
<p>The terms of the agreement are these:</p>
<ol>
<li>The Seminole will be the chief entity to operate legal sports betting in Florida, which will be available at their six tribal casino venues throughout the state, as well as at partner racetracks and card rooms. <em>Domestic online sports betting is not a component of the agreement.</em></li>
<li>The Seminole will be allowed to offer roulette and craps at their six Class III casinos. These game types were not included in the 2010 compact, and the tribe has been lobbying the state to allow these popular and profitable amusements for years. <em>Domestic online casino gambling is not a component of the agreement.</em></li>
<li>Third-party-banked and player-banked card games operated by non-Seminole entities – the earlier allowance for which led to the state being deemed in violation of the aforementioned 2010 Seminole gaming compact – will be allowed to continue operating the games they currently do, with no expansion thereof. <em>These venues will not be forced to close, and they will be allowed to host sports betting in a partnership deal with the Seminole.</em></li>
</ol>
<p>While every <a href="https://www.casinos18.com/states/florida/">Florida gambling</a> enthusiast is pleased with this development, one group – an anti-gambling outfit called “No Casinos” – is planning a legal challenge on the premise that the new deal “violates Amendment 3 in at least three ways.”</p>
<p>Amendment 3, which was passed in 2018 after a voter referendum yielded 71% support for the law, bans expanded gambling in the state <em>without</em> voter approval, and the argument from No Casinos is that this new deal violates the state constitution as so amended.</p>
<p>Per No Casinos president John Sowinski:</p>
<blockquote><p>“The proposed compact violates the letter and the spirit of Amendment 3. We call on the Governor and our Legislators to honor the will of the people, who demanded that any new casino gambling authorization occur at the ballot box, not behind closed doors in Tallahassee. We are committed to defending the integrity of Florida’s Constitution, and ensuring that the will of the people is respected.”</p></blockquote>
<p>The problem with this interpretation is that, in very basic terms, the new compact does no such thing – at least not clearly.</p>
<p>It doesn’t establish any new retail or online betting sites, which is the hallmark of expanded gambling.</p>
<p>Further, it doesn’t legalize new casino games that were previously unlawful <a href="http://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&amp;URL=0800-0899/0849/0849.html">per state law</a>.</p>
<p>The Seminole have not been allowed to offer roulette or craps, as specified in their 2010 Class III gambling compact with the state, but these activities are not themselves illegal for licensed and registered venues to offer to customers.</p>
<p>Unavailability does not imply illegality.</p>
<p>Finally, sports betting is only questionably considered a “game of chance,” and there is plenty of precedent elsewhere that it’s not viewed as a gambling game in the historical sense.</p>
<p>While the pastime is house-banked, it is not reliant wholly on random outcomes, and the skill of the bettor plays a significant role in whether that bettor wins or loses on aggregate.</p>
<p>Thus, it can be argued in court – and will likely be argued effectively in court by the state – that none of the new agreements with the Seminole constitute “expanded gambling.”</p>
<p>Of course, any challenge brought by No Casinos will also have to address tribal sovereignty, which could render their arguments moot on merit, jurisdiction, or both.</p>
<p>Nevertheless, such a challenge will delay the launch of these new games – and of domestic sports betting – in the state.</p>
<p>In other words, FL bettors may not have access to local retail roulette or craps for another year or more, and FL sports bettors may not be able to bet domestically on the lucrative and popular NFL season that gets underway in September.</p>
<p>Additionally, even when these new gambling markets <em>do</em> present themselves to Florida residents, the minimum age to participate will be 21 or older.</p>
<p>This leaves those seeking online casino gambling and online sports betting in the lurch, and it also hangs those players between the ages of 18 and 20 out to dry.</p>
<p>That said, if you’re 18+ and wish to enjoy iGaming or online sports betting legally and safely in Florida, you already can, regardless of what happens with the new Florida-Seminole tribal compact or the No Casinos suit.</p>
<p>That’s because the <a href="https://www.casinos18.com/states/florida/local/">best online 18+ Florida casinos</a> and <a href="https://www.casinos18.com/sportsbooks/">online 18-and-up sportsbooks</a> all accept players from the Sunshine State, and there are no laws on FL books that criminalize participation in real-money online gambling, sports betting, or poker.</p>
<p>Frankly, even once Florida’s new selections of casino games and sports betting opportunities go live, you’re still going to be better off playing online with legitimate 18+ offshore operators.</p>
<p>The games at these sites are far more varied and convenient while offering the same (or better) payout rates than domestic venues, and sports wagering locally will be heavily skewed on the odds boards for local Florida teams, of which there are many popular clubs across all major and collegiate sports.</p>
<p>In other words, you can bet on the Seminole Tribe all you want, but if you’re betting on the Seminoles football and basketball teams, you’re always going to get a bigger payout online than on-site.</p>

<p>The President had previously suggested that he alone would make the call for reopening on a national scale, but <a href="https://www.reviewjournal.com/news/politics-and-government/trump-will-let-governors-decide-when-to-reopen-states-2006589/">the Las Vegas journal is reporting</a> his change of message to state-level governance.</p>
<p>The response of state governors has been mixed, with some applauding the decision and others declaring that his judgment is misguided.  Trump believes that each state is positioned differently in the COVID-19 crisis and that a decision that affected all citizens equally would not be appropriate at this time.</p>
<p>Nevada is at the forefront of the gaming industry and is in the midst of its most prolonged shutdown in history. The massive financial losses are growing by the day, and the Las Vegas casino industry is desperate to get the money flowing once again.</p>
<p>On Tuesday, Nevada Governor Steve Sisolak Tweeted a statement saying that he would lean on the expertise of medical professionals when making a decision regarding the reopening of Nevada and its casino strip.</p>

										<content:encoded><![CDATA[<p>Depending on who you ask, some might say nothing ever gets done in Washington DC. Regardless of that stance, one thing has started: the DC sports betting license processing.</p>
<p>Just as planned, the District of Columbia started <a href="https://www.casino.org/news/dc-sports-betting-licensing-process-kicks-off-next-week-december-3/">reviewing applications on December 3</a> with the hopes that bets can be placed in time for Super Bowl LIV on February 2.</p>
<p>When the nation’s capital finally institutes its long-awaited sports betting, local 18+ gamblers can rejoice. <a href="https://www.casinos18.com/states/washington-dc/">Washington DC allows anyone 18 and over</a> to play the lottery, and since sports betting will be through the same agency, any legal adult can place wagers.</p>
<p>According to the DC Lottery, the approval process will take 30-45 days, which would allow the venues and groups just enough time to implement the necessary infrastructure for the NFL season finale.</p>
<p>The District first gave Intralot, a Greek lottery operator, the license to offer citywide mobile sports betting. However, Class A licenses are available for mobile and in-person wagering in four local sports arenas.</p>
<p>For example, the Capital One Arena, home to the Washington Wizards and Washington Capitals, has partnered with William Hill and will likely have sports betting available rather quickly.</p>
<p>Smaller establishments, though, such as the area’s bars, restaurants, and startups, must apply for a Class B license that could take<a href="https://sportsbetting.legal/news/dc-lottery-accepting-applications-sports-betting-licenses-thanksgiving/"> 3-6 months for processing</a>. Under that window of time, small businesses will miss the Super Bowl and possibly March Mardness.</p>
<p>Local businesses also face another hurdle that the larger groups don’t: the startup costs. According to Jeff Ifrah, an attorney that represents Bet DC– the local coalition of businesses looking to enter the sports betting realm– <a href="https://wtop.com/dc/2019/11/dc-bars-restaurants-hope-to-take-bets-by-super-bowl/">upfront expenses are a big problem</a>.</p>
<p>“We’d like to go with a brand that consumers know who can handle the geolocation,” Ifrah said. “It is the most expensive cost of this whole operation. It’s a problem. A big problem. We’re talking about a couple-hundred-thousand-dollars-a-year problem.”</p>
<p>Even getting to this point can be seen as a win for the District’s sports gambling prospects and local 18+ bettors. The timeline was first pushed back in October after a local mobile app filed a lawsuit against the city regarding the no-bid contract awarded to Intralot.</p>
<p>A Superior Court judge then issues a restraining order to block the first payment to Intralot, totaling $30 million, while the case was being resolved. 										<content:encoded><![CDATA[<p>Montana only has about four people per square mile within its state border. However, if things go according to plan, the Treasure State will also have sports gambling within those same lines.</p>
<p>As of right now, <a href="https://www.casinos18.com/states/montana/">Montana’s state gambling laws</a> allow 18+ bettors to play at casinos, parimutuels, offshore, and a few more options.</p>
<p>But just a couple weeks ago on November 21, the Montana Lottery Commission met in the capital of Helena to discuss legal sports betting.</p>
<p>The group <a href="https://www.krtv.com/news/montana-and-regional-news/sports-bet-montana-is-coming-soon">unanimously approved the sports gambling draft</a>, announcing it will be known as Sports Bet Montana.</p>
<p>“We’ve been working hard since May to create and build Sports Bet Montana,” Angela Wong, the Lottery Commission’s director, said in the press release.</p>
<p>Based on the state’s estimates, sports betting will raise the general fund from $1.5 million to $2 million in revenue. The new law would also bump the STEM scholarship fund from $3 million to $4 million.</p>
<p>If passed, Montana will also feature another big plus with their sports betting: mobile wagering. Although there were be some limitations.</p>
<p>Players, which looks to include those 18 and over, will be able to place their bets at licensed facilities or create “sports wagering accounts” with the state to play on mobile devices.</p>
<p>However, those <a href="https://www.kxlh.com/news/montana-news/montana-lottery-approves-rules-and-names-legal-sports-betting-in-montana">devices must be on the gaming facility’s property</a> or they will not work.</p>
<p>As for where those facilities will be, the state has already set those parameters. Only establishments that already have lottery ticket-selling machines, such as taverns and bars, may offer sports betting in the future.</p>
<p>“What that means for Montana is you won’t be seeing sports wagering at every grocery store and gas station that currently sells Montana Lottery,” Lottery communications manager Jennifer McKee said back in May. “It will be only locations that get a sports wagering license, and it will only be in locations where it makes sense.”</p>
<p>There is no official word on when sports betting will launch in Big Sky Country, but some time in 2020 is likely.</p>
<p>Montana became the first state to legalize sports betting in 2019 when Gov. Steve Bullock<a href="https://sportsbetting.legal/news/montana-sports-betting-rules/"> signed the bill into law on May 3</a>. <p>New York gambling regulators from the state Gaming Commission have approved of permitted sports gambling options at four upstate casino locations. The following upstate casinos are authorized to offer domestic sports betting: del Lago Resort Casino in the Finger Lakes, Resorts World Catskills in Monticello, Tioga Downs in the Southern Tier, and Rivers Casino and Resort in Schenectady. These casinos have yet to receive their sports gambling licenses from the state but will after the completed construction of their 6,000 sq ft sportsbook lounges likely ready by August 1<sup>st</sup>, in time for football season.</p>
<p>The del Lago Casino will be operating their sports gambling lounge in partnership with DraftKings where there will be 20 betting kiosks, TVs, a restaurant, and much more. Resorts World Catskills personnel plan on providing 35 TVs around a bar along with betting kiosks which could potentially accommodate more than 100 bettors.</p>
<p>The state and its governor have endorsed the allowance of sports betting at upstate casinos earlier in 2019 but needed to finalize details. New York’s federally recognized native tribes have expressed interest in offering sports gambling as well, and the state may permit sports wagering offers for up to 7 tribal-run casinos. At this time, the New York Gaming Commission established rules on sports wagering <a href="https://www.syracuse.com/news/2019/06/no-syracuse-sports-bets-for-you-ny-to-bar-wagers-on-in-state-schools.html">prohibiting any bets placed on New York-based collegiate sports and events</a>.</p>
<p><a href="https://www.casinos18.com/states/new-york/">New York</a> is hoping to expand this domestic sports gambling option via introduced legislation which would allow mobile sports wagering across the state and betting within sports arenas. However, the Governor of New York, Andrew Cuomo, has expressed concern for mobile sports wagering stating the change would require a constitutional amendment. In addition, the introduced legislation has yet to receive actionable results in either statehouse.</p>
<p>However, Attorney Daniel Wallach who is considered an expert on sports betting law testified to the New York Legislator in May that a state constitutional amendment would not be needed since the state has tweaked its gambling laws before with the addition of remote horse wagering without changing its constitution. Also, the introduced legislation by sponsor Senator Joseph Addabbo Jr states his bill would circumvent a state constitutional amendment by requiring mobile sports wagering to be routed through existing casino computer network servers. However, it seems Governor Andrew Cuomo is not budging on his stance.</p>

										<content:encoded><![CDATA[<p>In the last week of May, MA lawmakers will hear from nine introduced sports betting bills.</p>
<p>Massachusetts has yet to decide on whether to move forward with legalized domestic wagering. On May 28<sup>th</sup> through the 29<sup>th</sup>, the state will be hearing multiple sports betting bills presented in this year’s legislative session. The <a href="https://www.boston.com/news/local-news/2019/05/25/massachusetts-hearing-to-focus-on-sports-betting">bills will be heard by the Joint Committee on Economic Development and Emerging Technologies</a><strong>,</strong> but co-chair to the Committee Senator Eric Lesser says he &#8220;wouldn&#8217;t bet on it,&#8221; for the immediate acceptance and passage of these bills.</p>
<p>The hearings on May 28<sup>th</sup> will be an invite-only testimony hearing with stakeholders, and May 29<sup>th</sup> will hold a public forum.</p>
<p>The Committee had been tasked with studying sports betting and the potential effects of legalization in MA. Many <a href="https://www.casinos18.com/states/massachusetts/">Massachusetts </a>lawmakers are still unsure of what kinds of bets to allow, whether to allow collegiate game wagering and what tax rate to settle on for the domestic industry. It seems many legislators are floating in the same boat in a figurative open ocean of possibilities.</p>
<p>MA Governor Charlie Baker expressed support for domestic wagering and proposed the idea of allowing casinos and online providers like DraftKings to offer wagering to players 21 and over.</p>
<p>Some believe the pressure for MA to make up its mind is intensifying as football season nears. Likely the two-day hearing for the bills will help lawmakers solidify their positions.</p>
<p>Several questions would still need to be answered after the hearings. However, many believe the hearings will provide insight into these decisions such as the potential tax rate, who will regulate domestic wagering, the role of the MA State Lottery, whether to keep wagering at casinos or allow online betting, how to prevent minors from betting, and whether to apply integrity fees.</p>
<p>The Massachusetts State Lottery has watched the development of all MA sports betting bills and is concerned with keeping up with the expanding domestic gaming industry. Treasurer Deborah Goldberg and several officials from the lottery have argued for years to have the right to sell lottery products online to keep up with the growing competition, and this argument becomes louder with betting in consideration.</p>
<p>The Governor would prefer a finished ready-to-sign bill before August’s legislative recess when the NFL season starts. However, Representative Ann-Margaret Ferrante, who sits as co-chair to the Joint Committee on Economic Development, says this might not be so easy to do, “It’s a complex issue… It’s an issue that we want to be very diligent with, and we want to make sure should Massachusetts go forward with sports betting legalization &#8230; that we do it properly.”</p>
<p>Rep. Ferrante also shared some insights into the cost of liabilities vs. benefits, which if obligations outweigh profits may cause legislators to “turn around and say no” to betting. After the hearings conclude we will update readers with what legal sports betting avenue lawmakers have considered and rejected. 										<content:encoded><![CDATA[<p>Iowa’s Governor has provided the state’s residents with expanded gambling via a recently signed sports gambling bill.</p>
<p>Governor Kim Reynolds has signed <a href="https://www.legis.iowa.gov/legislation/BillBook?ba=SF617&amp;ga=88">Iowa’s Senate File 617</a>, a sports gambling and daily fantasy sports bill into law. With the passage of this legislation, Iowa is now the 3<sup>rd</sup> US state in 2019 to legalize domestic betting following Montana and Indiana. IA will be offering sports betting by the beginning of 2021.</p>
<p>The bill which was signed by Governor Reynolds received bipartisan support last month. IA players age 21 and older can gamble on sports gambling options licensed by IA through this passed legislation. Nonetheless, Iowa players interested in betting but who are only 18 years old can gamble on sports through licensed offshore <a href="https://www.casinos18.com/sportsbooks/">online sportsbooks</a>.</p>
<p>The state will be asking for $45,000 for IA businesses to obtain a betting license and $10,000 every year after to renew their license. Sportsbooks will be taxed 6.75% of their betting revenue. Iowa-based and licensed betting will be regulated by the Iowa Racing and Gaming Commission.</p>
<p>At this time, it is said that nineteen <a href="https://www.casinos18.com/states/iowa/">Iowa casinos</a> are eligible to offer domestic sports wagering. Casinos will be able to make two skins for their mobile betting app which if every casino offers two skins could provide 38 sports wagering brands to the IA gambling market.</p>
<p>FanDuel and DraftKings will be able to service Iowa players for fantasy sports wagering but not real money sports gambling.</p>
<p>The newly passed law also places prohibitions on betting on Iowa-based college teams and any in-game bets like prop bets. The legislation takes effect on July 1<sup>st</sup>, but lawmakers are still ironing out some minor details.</p>
<p>Sports gambling will be available in-person, online, and through mobile apps in IA. The hope is that online wagering will attract out of state bettors and more Iowan participants. All mobile or online wagering requires first-time user in-person registration.</p>
<p>The Iowa Governor’s spokesman Pat Garrett had this to say on the new law, &#8220;Gov. Reynolds believes that legalizing sports betting will bring this practice out of an unregulated black market.
