Brief History Of Montana’s Gambling Laws
The Treasure State’s gambling history begins like many other Western States, first early settlers brought card games and gambling games along with them, which sparked a thriving lottery market in the 1800s.
In 1889, The new constitution of Montana banned all types of gambling.
After the great depression, Montana repealed its prohibition in 1933, and pull tabs became popularized.
In 1937, the Montana legislature passed The Hickey Act, which legalized a variety of table games only if the county licensed them.
By 1945, slot machines were popping up everywhere and the state of Montana was on the losing end of the battle, thus they decided to legalize them for nonprofit organization purposes and collect taxes from them.
In 1949, Montana allocated $40,000.00 to begin enforcing gambling laws within their state.
By 1950, Montana’s Supreme Court made slots & punch boards illegal.
In 1973, legislatures passed the Card Game, Bingo, Raffles, and Sports Pool Act.
In 1976, to take the place of live bingo, the Supreme Court in Montana legalized video keno.
In 1984, the Montana Supreme Court ruled machines with video poker to be illegal. This was later overturned in 1985 by the passing of the Video Poker Machine Act, which allowed five poker machines per licensed liquor and unlimited keno machines.
In 1986, voters approved of the Montana Lottery.
In 1991, legislators lift the number limit on video poker machines and authorized a new limit, each establishment with a valid liquor license ould host a total of twenty machines for video gambling. That same year, Montana became one of only four states to be grandfathered out of the federal ban on sports betting and currently permits pari-mutuel wagering on horse races and simulcast racing, as well as permitting season-long fantasy sports.
