The Land of Enchantment is one of the most ecologically diverse states in the US and has offered a variety of gaming entertainment including New Mexico 18+ casinos, horse racing, lotteries, and card rooms. This state has a rich history with racetracks, as horses were important to daily life.
Eventually, the demand for horse races drove for the extension of race days during fairs. Tribal casinos are fairly new to the gambling industry in NM, in comparison to the state’s 40+ year bond with horse racing and sports betting.
However, these tribal casinos have the capability to offer sports gambling via their gaming compact with the state. Charity games are also offered as another avenue of available gambling to NM players.
New Mexico residents may already be aware of the gambling laws within the Land of Enchantment, however, their guests may not be so knowledgeable on existing laws concerning NM minimum gambling ages. We provide this guide to help players find suitable legal gaming options within NM and located outside of the US. There are different histories between states and this is reflected in each state’s gambling laws, learn more by reading various US 18+ casino laws.
Can You Gamble At 18 In New Mexico?
Players who have just turned eighteen are permitted to purchase lottery tickets, participate in pooled player wagers on horse races, video slot machines found at racetracks, and gamble in charity-hosted games like raffle drawings, bingo, pull-tabs, and door prize drawings. Other legal forms of gambling are restricted to players that are of the legal drinking age, 21.
This is an attempt to control underage drinking at gaming facilities, meaning players as young as 18 are not permitted in casinos and poker rooms which usually serve alcohol. However, there are other states that permit 18+ casino games and poker rooms. Not only that, land-based options are not the only gaming avenue players can take, there are plenty of legal 18+ online casinos which are based offshore.
Is It Legal To Gamble Online In New Mexico?
In essence yes, this is due to federal laws that do not ban legally sanctioned online offshore gaming destinations and permit states to regulate their own state-based gaming platforms. Most states have not moved on either creating state-run online casinos or outlawed offshore online gambling.
However, there are general laws that are understood stating that state-based online sites that are unregulated by the state itself are illegal, as well as, unlicensed offshore internet casinos. Since New Mexico does not offer a state-run online gaming platform, players as young as eighteen may enjoy online casinos that are on servers located outside of the US and licensed by the international gaming authorities.

Brief History Of New Mexico’s Gambling Laws
Horse races were so popular and profitable in New Mexico, officials extended race days at state fairs to increase purses and profits.
In the 1930s, NM legalized pari-mutuel wagering on horses.
It wasn’t until 1946 when La Mesa Park opened, and the first horse races began running.
In 1988, IGRA was federally established to permit gambling on sovereign tribal land.
By 1990, NM’s Governor King begins negotiating gaming compacts with native tribes within its borders.
In 1995, Johnson prematurely signed tribal gaming compacts without the binding authority of the state. However, during this year he instated a state-run lottery.
It was not until 1997, that 13 Indian gaming agreements were finally bound to the state when they were passed by the legislature and signed by the new governor Johnson.
In 1999, NM formalizes its negotiating process with tribes, by adhering to the Compact Negotiation Act.
In 2000, a lawsuit occurred between the NM Attorney General and the tribes for the non-payment of their revenue sharing.
By 2001, new compacts were negotiated and approved by the state legislature to offer class III games. All but two tribes signed off on the new compacts until the disputes between the state and the individual tribes were settled. This was done by 2005.
In 2007, there were amendments made to the 2001 compacts. These amendments were approved by the state and signed by tribes.
In 2016, legislation was introduced to legalize daily fantasy sports. This is still open for discussions.
In 2018, PASPA was revoked by the Supreme Court; New Mexico’s Tamaya tribe finds legal loophole via their gaming compact with the state which allows their casino to offer sports gambling as permitted under their Class III gaming license.
