Brief History Of Wisconsin’s Gambling Laws
Upon obtaining its state-ship, WI’s original constitution contained heavy anti-gambling clauses and remained this way for about 150 years. Slowly, over time, the Badger state has loosened its grip on anti-gambling policies and carved out special exceptions throughout the past 50 years to create the gambling environment now found within WI.
In 1848, Wisconsin earned its statehood and, in this same year, drew a constitution that outlawed all forms of gambling and made gaming debts noncollectable.
Between 1848 and the mid-1900s horse racing was popularized and a common sport. However, betting on such races was considered illegal.
In 1929, WI repealed prohibition. This was monumental, as prohibition was not repealed nationwide until 4 years later.
In 1940, the WI Supreme Court ruled bingo as an illegal lottery. This received a lot of push back from residents.
By 1965, voters ratified an amendment to allow sweepstakes and other promotional contests.
In 1973, voters approved bingo gambling for charitable causes.
By 1977, raffles were permitted as charitable games.
In 1987, voters approved of a state lottery, and pari-mutuel betting on horse and dog races became legal.
By 1988, the Indian Gaming Regulatory Act passed nationwide and allowed for tribal gaming facilities on their land. The first WI lottery was also drawn this year.
During 1991-1992, the first tribal compacts were signed between 11 native tribes and the state of Wisconsin.
